Enforcement of Covenants is a difficult task, except when specific items are listed as violations. I believe the listing of roads, fences, ditches and agricultural structures is a listing of the most anticipated violations requiring enforcement actions from the Board. When the Board does not act, Members are benefited by being able to present to the Courts a specific listing of the most anticipated violations.
I believe that rather than making this section less enforceable by removing the examples, a more detailed listing is required. The approval of the Master Plan and proposed change to allow structures of less than 200 square feet to be built without any review of the Board generate greater potential for problems in maintaining an appealing community in which to live.
I suggest the following change to 6.07
6.07. Maintenance. All structures and improvements visible from platted roads or neighboring parcels, including roads, fences, ditches, accessory buildings, outbuildings, sheds, garages, guest housing and agricultural structures, shall be properly maintained and kept in good condition by Landowners so that they are not allowed to become dangerous, unsightly or unsanitary, or to cause a fire hazard
Within the Covenants is the following statement:
"It is the intent of these covenants that the Community of Glastonbury should be predominantly rural/residential community that allows for the reasonable and productive exercise of free enterprise by its residents, and which both encourages fixture orderly growth and protects valuable rural and residential land qualities. "
